Welcome to Barrier Lifter! By installing and using our application, you agree to comply with and be bound by the following Terms of Service. Please read them carefully.

1. Acceptance of Terms

By installing and using Barrier Lifter, you (“User”) agree to these Terms of Service (“ToS”). If you do not agree with any part of these terms, you must not use the app.

3. Eligibility

There are no specific age, geographic, or legal restrictions for using Barrier Lifter. However, you are solely responsible for ensuring that your use of the app complies with all applicable laws and regulations.

4. User Responsibilities

  • App Configuration: You are responsible for configuring the app by adding the first name, last name, and phone number of authorized users.
  • Passphrase Management: Users must define and securely manage the passphrase that will trigger the app to perform actions, such as making calls to open gates.
  • Device Security: Although no account is required, you must maintain the security of your device to prevent unauthorized access to the app.

5. Permitted and Prohibited Uses

  • Acceptable Use: You may use the app for any lawful purpose.
  • Prohibited Activities: Misuse of the app is strictly prohibited, including reverse engineering, decompiling, or otherwise tampering with its functionality. Such behavior may result in termination of access to the app.

6. Costs and Charges

  • Carrier Costs: Any SMS messages received by the device running Barrier Lifter, as well as calls made by the app to operate gates or barriers, may incur costs from your cellular provider. You are solely responsible for monitoring and covering any such costs. The developer assumes no liability for these charges.

7. Other Features

  • Notifications: Administrators can receive SMS notifications when users enter or exit, available per user.
  • Inspirational Messages: Users can also configure the app to send a daily inspirational message, personalized with the user’s first name, whenever they first leave for the day. This feature can be toggled in the settings.

8. Data Collection and Privacy

  • Data Collected: The app collects the first name, last name, and phone number of authorized users, as well as interaction logs. This information is stored locally on the user’s device and never shared with third parties.
  • No Data Sharing: The app operates entirely offline, and the developer does not collect, share, or access any of the data stored in the app. You are responsible for the data stored on your device.
  • Data Retention: All data remains on your device for as long as you keep the app installed.

9. Intellectual Property

  • Ownership: Barrier Lifter and all associated intellectual property rights are owned by Xan kasky.
  • User-Generated Content: The app does not support user-generated content. If any content is generated, the user retains full ownership.

10. Termination

  • Developer Rights: The developer reserves the right to terminate or suspend access to the app at any time, without notice, particularly for violations of these ToS.
  • User Rights: You may stop using the app at any time by uninstalling it from your device.

11. Disclaimers and Limitation of Liability

  • No Warranty: The app is provided “as is” without any warranties, either express or implied. The developer does not guarantee that the app will always function correctly or meet your expectations.
  • Liability Limits: The developer will not be liable for any damages arising from the use or inability to use the app, including but not limited to direct, indirect, incidental, or consequential damages.

12. Indemnification

You agree to indemnify and hold harmless Xan Kasky from any claims, damages, losses, or costs arising from your use of the app, your violation of these ToS, or your infringement of any rights of a third party.

13. Governing Law and Dispute Resolution

  • Governing Law: These ToS are governed by the laws of Romania.
  • Dispute Resolution: Any disputes shall be resolved through binding arbitration in accordance with Romanian law.

14. Modifications to the Terms of Service

  • Change Notification: The developer may update these ToS from time to time. You will be notified of changes via app updates.
  • User Acceptance: Continued use of the app after changes are made constitutes acceptance of the updated terms.

15. Miscellaneous

  • Entire Agreement: These ToS constitute the entire agreement between you and the developer regarding the use of the app.
  • Severability: If any part of these ToS is deemed unenforceable, the remainder will remain in full effect.
